When you book a campsite through Utopia Unlimited you are agreeing to the following Waiver and Release of Liability.
1. Assumption of Risk
I acknowledge that camping on private property involves exposure to natural and man-made hazards that may cause injury, loss, or death. These risks include, but are not limited to:
- Falling branches or trees (particularly from large gum trees)
- Unfenced waterways, creeks, dams, and other water hazards
- Uneven, rocky, or slippery terrain
- Exposure to wildlife, livestock, insects, and domestic animals
- Fire risks, including campfires and bushfire conditions
- Weather events such as wind, rain, storms, and flooding
- Use of camping equipment, vehicles, and outdoor facilities
I understand that large gum trees can drop heavy limbs without warning, and I agree not to camp, park vehicles, or set up tents directly beneath large trees.
I voluntarily accept and assume all such risks, both known and unknown, and take full responsibility for my safety and the safety of all minors or guests under my care.
2. Release of Liability
In consideration of being permitted to camp on this private property, I, for myself and on behalf of my heirs, executors, and assigns, hereby release, discharge, and hold harmless the property owner(s), their agents, family members, employees, or volunteers from any and all liability, claims, demands, or causes of action arising out of or related to any injury, death, or property damage occurring during my stay, whether caused by negligence or otherwise.
This includes incidents resulting from natural conditions of the land, such as falling branches, unfenced waterways, uneven ground, and encounters with wildlife.
3. Indemnity
I agree to indemnify and hold harmless the property owner(s) and their representatives from any claims, costs, damages, or expenses (including legal fees) arising from my use of the property, my conduct, or that of my guests or pets, or any breach of this agreement or property rules.
4. Property Rules
I agree to follow all rules and instructions provided by the property owner(s), including but not limited to:
- Camp only in designated areas and respect property boundaries.
- Do not camp directly under large gum trees or branches that could fall.
- No littering or environmental damage — take all rubbish with you.
- Fires only in designated fire pits, subject to local fire bans and weather conditions.
- Respect wildlife, livestock, and noise restrictions at all times.
- Pets must be declared and kept under control; owners are responsible for any damage or disturbance.
- Waterways are unfenced and may be deep or slippery — use at your own risk.
5. Medical and Emergency Consent
In the event of accident, illness, or emergency, I authorize the property owner(s) or their representative to obtain medical treatment as deemed necessary, and I agree to bear all costs associated with such treatment.
6. Acknowledgment
I confirm that I have read this waiver and understand its contents. By confirming this booking, I acknowledge that I have read and understood this waiver, and I agree to these terms on behalf of myself and all members of my group.
